Most trusts and estates attorneys are concerned about the impact of the proposed estate tax repeal on their practice, but only half have a plan for growth/survival; few attorneys believe they will be forced out of estate planning.

     Trusts and estates attorneys believe a repeal of the federal estate tax will force them to add new practice areas in order to survive, but few say they will leave the practice of estate planning. Half of the respondents said they believed the tax would be repealed or phased out sometime this year. While 73 percent of respondents said they were concerned about how the proposed repeal would affect their practice, only 7 percent said they would leave the practice of estate planning.
     “This survey confirms what most estate planning experts have predicted – that repeal of the estate tax will have a significant impact on the practice of trust and estates law,” said Kyle Krull, president of Integrity Marketing Solutions and a trusts and estates attorney. “Without estate taxes as a motivating factor, there is likely to be a measurable decline in estate planning activity.”
     While many respondents acknowledged that elimination of the tax would make wealthy individuals less likely to pursue estate planning, 76 percent said they still see substantial new opportunities in this practice area. About half said they had a plan for the growth/survival of their estate planning practice if the tax is repealed. Of respondents who said they would transform their practices to include additional services:  

  • 80 percent said they would add estate trust and probate administration.

  • 63 percent said they would add probate avoidance planning.

  • 48 percent said they would add business/corporate law.

  • 38 percent said they would add elder law.

  • 26 percent said they would add financial/investment planning.

  • 25 percent said they would add contested estate litigation.

     “In comments accompanying the survey, many attorneys emphasized that clients will be less motivated to pursue estate planning and they will have to be more aggressive in marketing their practices,” said Jennifer Campbell, vice president and chief executive officer of Integrity Marketing Solutions. “Estate planning practitioners need to plan now so they have marketing strategies in place to support not only their estate planning services, but these related service areas as well.”
     The survey was conducted online by Integrity Marketing Solutions in February, 2001. More than 200 attorneys responded, ranging from those with solo practices to attorneys in national firms with 100 or more attorneys.
